1. Scope of Services

Khojmaster Property Consultants (“The Firm”) acts as an intermediary for the sale, purchase, lease, and investment of real estate properties in Mumbai, with a focus on premium residential and commercial assets. All services are subject to the following terms.

2. Client Obligations

Clients agree to:

Provide accurate and complete information regarding their property or property requirements.

Disclose any material facts about a property they wish to sell, lease, or assign.

Not engage in parallel negotiations with other brokers without prior written notice, if an exclusivity agreement is signed.

3. Brokerage Fees

Sale Transactions: 2% of the total sale consideration from each party (buyer & seller), unless agreed otherwise in writing.

Lease/Rent Transactions: One month’s rent from both lessor and lessee, payable at the time of agreement execution.

All fees are exclusive of applicable taxes.

4. Payment Terms

Brokerage becomes due and payable on the signing of the Agreement to Sell / Leave & License Agreement, regardless of final registration.

Payment must be made within 7 working days from the date of invoice.

Delayed payments may attract interest at 18% per annum from the due date.

5. Exclusivity

If a client has signed an exclusive mandate with Khojmaster Property Consultants, the client agrees:

Not to appoint or entertain any third-party brokers for the term of exclusivity.

To refer all inquiries or offers to the Firm directly.

6. Limitation of Liability

The Firm:

Is not liable for legal, financial, or tax implications arising from a transaction.

Recommends that clients engage their own legal and financial advisors.

Shall not be held responsible for any delays, disputes, or cancellations between transacting parties.

7. Property Verification

The Firm undertakes best-effort verification of property documents and titles. However, clients are advised to:

Conduct independent due diligence

Appoint legal counsel for verification of ownership, encumbrances, and approvals

8. Confidentiality

All discussions, documents, and client data are handled with strict confidentiality. The Firm will not disclose any sensitive information without prior consent, except as required by law.

9. Governing Law & Jurisdiction

These terms shall be governed by the laws of India. Any disputes arising shall be subject to the exclusive jurisdiction of the courts in Mumbai, Maharashtra.

10. Modifications

Khojmaster Property Consultants reserves the right to modify or update these terms at any time without prior notice. Clients are advised to review the latest version available on our website or upon request.
